The Prime Minister has just issued Decree No. 21/2011/ND-CP dated
Mar 29th 2011 providing details and measures to implement the Law on energy efficiency
and conservation. Accordingly, equipment and devices on the List must be energy
labeled before being launched to the market. The Decree shall take effect from May
15th 2011.

Currently, the market has a number of energy labeled
products such as compact fluorescent lamps of Dien Quang, Rang Dong, Philips and
electric fans of Viet Nam Electric fan Co., Lien Hiep and Tan Tien SK Co.
Decree 21/2011/ND-CP dated Mar 29th 2011 provides regulations
on statistics on energy use, key energy consuming facilities, energy efficiency
and conservation in offices and units using State budget; energy labeling for energy
consuming equipment and devices; measures to promote energy efficiency and
conservation; examination and inspection on energy efficiency and conservation.
Accordingly, statistical indicators on energy use in the
system of national statistical indicator shall be applied uniformly throughout
the country and updated annually, including the main groups of indicators such
as indicators on quantity and volume of energy use classified according to economic
sector, key energy consuming establishment, purpose of use, type of energy; indicators
on energy consumption modulus classified according to a number of key products;
indicators on quantity and type of energy consuming facilities and equipment on
the List of must-be-energy-labeled energy consuming facilities, equipment which
are produced or imported.
Facilities and equipment on the List of must-be-energy-labeled
facilities and equipment must be labeled before being launched to the market. Energy
labels include two types: comparative label provides information on energy consumption,
type of energy, energy efficiency and other information to help consumers compare
with products of the same kind in the market to identify and select energy
saving facilities and equipment; confirmative label certifies that facilities and
equipment have the highest energy efficiency compared to other facilities and
equipment of the same kind.

Each year, agencies and units using state budget are
required submit report on energy use to the competent State management agency.
Contents of the report include annual plan of energy use; plan to replace or purchase
new facilities, repair equipment; annual targets and measures of saving energy;
the use of energy, facilities and equipment which have been replaced, newly purchased
or repaired and other energy saving measures which have been implemented during
the year, compared with the plan.
In addition, the Decree also clearly stipulates that
organizations and individuals investing in the production of energy saving
products, products using renewable energy in Vietnam shall enjoy tax incentives,
financial support and land support for the construction of production
facilities.
Facilities, equipment, parts and components saving energy or
using renewable energy, which cannot be domestically produced, shall enjoy import
duties exemption or reduction in accordance with tax legislation, including: Parts
and components for manufacturing energy saving lighting facilities and
equipment; facilities and equipment using solar energy, wind power; ...
Production facilities and importing enterprises shall execute
the printing and sticking of energy labels for facilities and equipment which
have been granted the certificates on energy labeling.
60 working days before the validity of the certificates on energy
labeling expires, production facilities, importing enterprises must register
for re-certification.
